Dynamic purchasing system set up pursuant to Act No. 137/2006 Coll., in the wording effective by the date of the entry of the Public Procurement Act No. 134/2016 Coll. (PPA) into effect, shall be considered the dynamic purchasing system pursuant to PPA from the entry of PPA into effect.
Public contracts awarded under the DPS which were commenced before the effective date of PPA shall be completed pursuant to Act No. 137/2006 Coll., in the wording effective by the date of the entry of PPA into effect.
In comparison with the previous legal regulation setting up of a dynamic purchasing system is according to the rules of the restricted procedure instead of the rules of opening procedure. There is no submission of pre-tenders but contractors submit requests. The contracting authority may divide the dynamic purchasing system into categories that are objectively defined on the basis of the subject-matter of the public contracts or on the basis of their territorial scope.
The new Public Procurement Act No. 134/2016 Coll.contains detailed legal regulation of electronic catalogues. The contracting authority may request or admit that a tender be presented in the form of an electronic catalogue.
